“This final scrutiny prohibits the requalification of votes and discussions aimed at it.” That is one of the instructions in the final vote scrutiny guide ballot by ballot that the Supreme Electoral Tribunal (TSE) issued for the final scrutiny of the legislative election, which was questioned by opposition parties who demand that all votes be reviewed.
The provision is based on the idea that the Voting Receiving Boards (JRV) carried out the preliminary scrutiny “counting and classifying the ballots and votes of each election in due form and safeguarding them in the respective bags within the electoral package,” the guide indicates, despite many reports of problems in the counting at the tables and filling out of minutes.
The count began late at around 4 p.m. on Sunday after several reschedules.
Claudia Ortiz, of the Vamos party, said yesterday morning that they disagree with not being able to review null and contested votes. “The ballot that a JRV has qualified as null should be publicly displayed at the table in the interest of transparency,” she said.
She considered that given the allegations that on February 4 members of JRV were replaced by a party, “the bad practice” could have occurred that valid votes for the opposition were considered null votes.
The electoral package contains bags with valid votes, null ones, contested ones, abstentions, leftover ballots, and the signature register. “What has been determined in the guide is that only the bag of valid votes will be taken out, the valid votes will be recounted, and a new record will be made, a new record that will replace those that were issued irregularly due to the entire failure that occurred,” she added.
Andy Failer, of Nuestro Tiempo, added that it was a TSE agreement not to requalify the ballots, and there is a risk that valid votes will remain null. “There is something very serious here, they are violating the popular will of the citizens expressed on February 4,” he explained.
He indicated that what they seek is for all votes to be counted and that “it is the last chance” for the Electoral Court to be consistent. “The credibility of the TSE is at stake; it is already very fragmented today, not to say on the ground. We ask them to take their work seriously and to requalify the ballots according to what the citizens expressed at the polls,” he said.
He considered that the TSE is not fulfilling its commitment to count ballot by ballot as indicated last Monday.
Ortiz also said that during the meeting with the parties, Nuevas Ideas asked the TSE not to limit the number of watchdogs and to have one for each table with their substitutes, due to the TSE determining that up to 100 watchdogs per party would be allowed when there are 300 counting tables, so they asked for 300 watchdogs for each.
Carlos García Saade, president of the ARENA party, commented that “it is practically going to be a ballot counting process” and also asked for the requalification of ballots so that in the case that valid votes have been recorded as null or contested “they become from the party that got them.”
“We, as parties, have the right that if the votes are wrong, either intentionally or by mistake, in a place where they do not belong, and if a vote of any party has been wrongly annulled, it is not only about ARENA’s votes, but about all the parties, all Salvadorans who went out to vote to express their will, they must be reclassified,” he said.
Another request was to review the signature register to verify that the number of ballots corresponds to the number of votes cast.
Respect for JRV work
When asked about the parties’ requests, magistrate Guillermo Wellman assured that they will not change what was already qualified by the JRV. “Because they were the highest authority at the time of voting, they already did part of the work. It is already qualified by the person responsible for the process,” he said.
He even pointed out that “the irresponsible ones were the members of political parties who left the JRV behind and abandoned their posts” in reference to the problems of the preliminary scrutiny on February 4.
In the case of monitoring by political parties in the final scrutiny process, Wellman said that everyone was invited. “Those who have wanted to have participated. We are not going to force them, but by responsibility for having delayed the scrutiny by having abandoned it, they should be present here,” he said.
Nuevas Ideas militants arrive en masse
It was not until Sunday afternoon when the TSE performed the zero set-up of the system for the final scrutiny of the legislative election. It was determined to begin with the departments of San Vicente and Cabañas because they have fewer packages until completing with San Salvador.
Although it was indicated that there would be up to 100 watchdogs for each political party, Nuevas Ideas militants arrived en masse at the gym, shouting slogans.

Two shifts will be implemented at the 300 tables, lasting 12 hours. It also delimited the participation of the Attorney General’s Office (FGR) with one attorney for every two tables, that is, 150 attorneys per shift, 40 representatives of the Electoral Surveillance Board (JVE), four from the Attorney General’s Office (PGR), and four from the Human Rights Attorney’s Office (PDDH).
Partidos cuestionan que TSE no permitirá que se revisen todos los votos
“Se prohíbe en este escrutinio final la recalificación de votos y las discusiones orientadas a ello”. El conteo inició retrasado cerca de las 4 de la tarde del domingo después de varias reprogramaciones.
Claudia Ortiz, del partido Vamos, dijo ayer por la mañana que no están de acuerdo con que los votos anulados e impugnados no se puedan revisar. “Debería hacerse público en la mesa la papeleta que una JRV ha calificado como nulo, en aras de la transparencia”, dijo.
Consideró que ante las denuncias que el 4 de febrero se sustituyeron miembros de JRV por un partido “pudo darse la mala práctica” que votos válidos para la oposición se hayan puesto como votos nulos.
El paquete electoral contiene las bolsas con los votos válidos, los nulos, los impugnados, las abstenciones, las papeletas sobrantes y el padrón de firmas. “Lo que se ha determinado en el instructivo es que se va a sacar solo la bolsa de votos válidos y los votos válidos se va a volver a contar y se va a registrar acta, una nueva acta que va a sustituir a las que fueron emitidas de una forma irregular por todo el fallo que sucedió”, añadió.
Andy Failer, de Nuestro Tiempo, agregó que fue un acuerdo del TSE de no recalificar las papeletas y que se corre el riesgo que votos válidos se queden como nulos. “Aquí hay algo muy grave, están vulnerando la voluntad popular de la ciudadanía de lo que se expresó el 4 de febrero”, expuso.
Indicó que lo que buscan es que se cuenten todos los votos y que “es la última oportunidad” del Tribunal Electoral en ser coherente. “La credibilidad del TSE está en juego, ya por hoy está muy fragmentada, por no decir que está en los suelos. Les pedimos que se tomen en serio su trabajo y se recalifiquen las papeletas según lo expresó la ciudadanía en las urnas”, expresó.
Consideró que el TSE no está cumpliendo con su palabra de contar papeleta por papeleta como lo indicó el pasado lunes.
Ortiz también dijo que en la reunión con los partidos, Nuevas Ideas pidió al TSE que no se limitara la cantidad de vigilantes y que haya uno por cada mesa con sus suplentes, eso debido a que el TSE determinó que se permitirá hasta 100 vigilantes por partido cuando son 300 mesas de escrutinio, por lo que pidieron 300 vigilantes para cada uno.
Carlos García Saade, presidente del partido ARENA, comentó que “prácticamente va a ser un proceso de conteo de papeletas” y que también pidió que se permita la recalificación de papeletas, para que en caso que hayan registrado votos válidos como nulos o impugnados “pasen a ser del partido que los sacó”.
“Nosotros como partidos tenemos el derecho a que si los votos están mal, intencionadamente o por error, en un lugar donde no le compete, si han anulado de mala forma un voto de cualquier partido, no solo se trata de los votos de ARENA, sino de todos los partidos, de todos los salvadoreños que salieron a votar a expresar su voluntad, tienen que reclasificarse”, dijo.
Otra de las peticiones era que pueda revisarse el padrón de firmas para verificar que la cantidad de papeletas corresponden a la cantidad de votos emitidos.
Respetar trabajo de JRV
Al ser consultado sobre las peticiones de los partidos el magistrado Guillermo Wellman aseguró que no van a cambiar lo que ya fue calificado por las JRV. “Porque ellos en ese momento eran la máxima autoridad en el momento de votación, ya hicieron parte del trabajo. Ya está calificado por la responsable del proceso”, afirmó.
Incluso señaló que “los irresponsables fueron los miembros de los partidos políticos que dejaron tirada la JRV y abandonaron su puesto” en referencia a los problemas del escrutinio preliminar el pasado 4 de febrero.
En el caso de la vigilancia de los partidos políticos en el proceso de escrutinio final, Wellman dijo que se invitó a todos. “Se han presentado los que han querido. No los vamos a obligar, pero por responsabilidad de que se retrasó el escrutinio por haber dejado abandonado deberían estar presentes aquí”, dijo.
Militantes de Nuevas Ideas llegan en masa
No fue hasta la tarde de este domingo cuando el TSE realizó la puesta a cero del sistema para el escrutinio final de la elección legislativa. Se determinó comenzar con los departamentos de San Vicente y Cabañas porque tienen menos paquetes hasta finalizar con San Salvador.
Aunque se indicó que habría hasta 100 vigilantes por cada partido político, los militantes de Nuevas Ideas llegaron al gimnasio en masa abrumadora gritando consignas.
La presidenta del TSE, Dora Martínez, solo indicó que se convocó a todos los partidos.
Por la mañana, el TSE capacitó al personal que estará a cargo de registrar los datos al sistema, así como pruebas del funcionamiento de la plataforma, donde se detectaron problemas que fueron calificados por el director ejecutivo del TSE, Luis Peralta, como “problemas humanos”. “Hoy en la prueba que hicimos en la mañana hubo problemas con un escáner, hubo problemas nuevamente con impresores, pero ya son problemas más humanos pero no del sistema. Hubo problemas también con la transmisión, que en algunos casos se puso lenta, pero eran más problemas humanos de las personas que estaban digitando que no habían escaneado, por ejemplo, las tres páginas del acta”, expresó.
Se implementarán dos turnos en las 300 mesas, de 12 horas. También delimitó la participación de la Fiscalía General de la República (FGR) en un fiscal por cada dos mesas, es decir, 150 fiscales por turno, 40 representantes de la Junta de Vigilancia Electoral (JVE), cuatro de la Procuraduría General de la República (PGR) y cuatro de la Procuraduría de los Derechos Humanos (PDDH).
