Ernesto Muyshondt, former mayor of San Salvador, will face a public hearing on April 10 for the crime of non-performance of duty at the Fifth Sentencing Court of the capital. In this process, the former treasurer of the municipality, Fernando Heriberto Portillo Linares, and the former director of finance, Santos Omar Muñoz González, are also charged.
According to the Attorney General’s Office (FGR), the former officials are accused of being responsible for withholding $5,217,129.47 in labor fees to the detriment of 41 victims and 54 financial institutions, including Pension Fund Administrators (AFP), various trade unions, banks, cooperatives, among others.
This is the second process that this Court will see against Muyshondt, as the other one is for the crime of improper appropriation of withholding or tax payments. In this process, Portillo Linares and the former director of Solid Waste, Francisco José Rivera Chacón, are also involved.
Deny rumors about his death
People close to the former mayor and his family denied to LA PRENSA GRÁFICA the rumors about his death in prison, which spread on April 1 on social media.
“No, it’s not true, deny it,” said a source close to the situation who preferred anonymity.
“I have received many calls about it. There is nothing official or unofficial that indicates he has died,” added another source close to the family.
Muyshondt has been under provisional arrest since 2021, so he has already served the maximum time for this measure. However, the authorities have not released him due to other pending processes. It is known that for now he is being held in the “Doctor José Molina” National Psychiatric Hospital in Soyapango.

Ernesto Muyshondt, exalcalde de San Salvador, enfrentará este 10 de abril la vista pública por el delito de incumplimiento de deberes en el Tribunal Quinto de Sentencia de la capital. En este proceso también están imputados el extesorero de la alcaldía, Fernando Heriberto Portillo Linares, y el exdirector de finanzas, Santos Omar Muñoz González.
De acuerdo con la Fiscalía General de la República (FGR), los exfuncionarios son señalados de ser responsables de retener $5,217,129.47 en concepto de cuotas laborales en perjuicio de 41 víctimas y 54 entidades financieras, entre ellas las Administradoras de Fondos de Pensiones (AFP), varios sindicatos, bancos, cooperativas, entre otros.
Es el segundo proceso que este Tribunal ve contra Muyshondt, ya que el otro es por el delito de apropiación indebida de retenciones o percepciones tributarias. En este proceso también están Portillo Linares y el exdirector de Desechos Sólidos, Francisco José Rivera Chacón.
Niegan rumores sobre su muerte
Allegados al exedil y personas cercanas a su familia desmintieron a LA PRENSA GRÁFICA los rumores acerca de su fallecimiento dentro de centros penitenciarios, el cual circuló este 1 de abril en redes sociales.
“No, no es cierto, desmiéntalo”, se refirió una fuente cercana que prefirió el anonimato.
“He recibido muchas llamadas al respecto. No hay nada oficial ni extraoficial que indique que ha fallecido”, agregó otra fuente cercana a la familia.
Muyshondt permanece bajo arresto provisional desde 2021, por lo que ya cumplió con el tiempo máximo de esta medida. Sin embargo, las autoridades no lo han dejado en libertad por otros procesos pendientes. Se sabe que por ahora guarda detención en el Hospital Nacional Psiquiátrico “Doctor José Molina”, en Soyapango.
