La Unidad por la Defensa de los Derechos Humanos y Comunitarios de El Salvador (Unidehc) (The Unit for the Defense of Human and Community Rights of El Salvador) and residents of the La Floresta community in San Juan Opico, La Libertad, describe the arrest of community leaders Medardo Antonio Rodríguez and Alejandra Jeannette Cañas as arbitrary, as both have been denouncing eviction attempts in the area.
According to accounts from some residents, members of the Policía Nacional Civil (PNC) (National Civil Police) together with a member of the Fiscalía General de la República (FGR) (Attorney General’s Office) arrived this past Sunday, February 9 of this year in the community where Medardo and Alejandra were, and after speaking for a few minutes, the officers told the residents that both would be placed under arrest. They assert, however, that no arrest warrant was presented.
“When the police officer came out, he told us they were going to be arrested. We asked him why, and he told us that there (at the station) they would figure out the reason for which they were being arrested. I think it’s strange that they were detained without committing a crime and without presenting a warrant. The prosecutor didn’t have any document. We want to support them, not leave them alone,” said one resident.
According to statements from attorney and Unidehc spokesperson, Rudy Joya, the detention took place during measurements being carried out as part of legal processes for nearly 100 families, aimed at issuing deeds and establishing prescription of properties and real estate.
Unidehc’s technical team was assisting with these tasks when personnel from the PNC’s anti-gang unit and detectives arrived.
“In an overbearing manner, the agents asked the members of the board—formed to defend rights—to accompany them to the Ciudad Arce station because the prosecutor wanted to speak with them, without a court order. Even so, by force, the agents put five people in the pickup, took them to the station, and once there, released three of the spokespersons, telling them they could leave. However, the leader and his wife remained detained without clarifying the reason for their arrest,” he stated.
Joya adds that the officials only shared information with the lawyers. That evening, Medardo and Alejandra were placed in different stations. “For this reason, we denounce these actions, demand the leaders’ freedom, and call for respect of their right to bodily integrity and that they not be subjected to cruel and inhuman treatment, as police and prosecutors are known to do in these cases,” he said.
As of the close of this report, the Unidehc technical team had still not been informed of the reason or alleged crimes for which Medardo and Alejandra were being detained.
LA PRENSA GRÁFICA contacted, through its communications teams, both the PNC and the FGR regarding the complaint from Unidehc and members of the La Floresta community about what they consider the arbitrary arrest of two local leaders on Sunday, February 9. As of this report’s conclusion, their response was still pending.
In May 2024, Unidehc denounced an attempted arbitrary eviction in the La Floresta community, a situation that was reported to the Prosecutor’s Office but saw no significant progress in the investigation, according to Unidehc.
Denuncian capturas de líderes comunitarios en San Juan Opico
La Unidad por la Defensa de los Derechos Humanos y Comunitarios de El Salvador (Unidehc) y habitantes de la comunidad La Floresta, en San Juan Opico, La Libertad, catalogan de arbitraria la captura de los líderes comunitarios Medardo Antonio Rodríguez y Alejandra Jeannette Cañas quienes han denunciado los intentos de desalojos en el sector.
Según el relato de algunos habitantes, elementos de la Policía Nacional Civil (PNC) junto a un miembro de la Fiscalía General de la República (FGR) llegaron el pasado domingo 9 de febrero de este año a la comunidad donde se encontraban Medardo y Alejandra y luego de hablar por unos minutos los agentes dijeron a los habitantes que ambos quedarían detenidos, pero aseguran que no fue presentada ninguna orden de detención.
Cuando salió el policía nos dijo que ellos iban a ser detenidos. Les preguntamos por qué y nos dijo que ahí (en la delegación) iban a ver cuál era el motivo por que quedaban detenidos. Siento que es raro que los hayan detenido sin cometer delito y sin presentar orden. El fiscal no tenía ningún documento, queremos darles el apoyo, no dejarlos solos”, manifestó una habitante.
Según externó Rudy Joya, abogado y vocero de Unidehc, la detención se llevó a cabo durante las mediciones que se estaban desarrollando producto de los procesos legales en casi 100 familias para procesos de escrituración y prescripción de propiedades e inmuebles.
El equipo técnico de Unidehc apoyaba en estas labores cuando personal de la unidad antipandillas y detectives de la PNC se hicieron presentes.
De manera prepotente, los agentes le piden a los encargados de la directiva que se ha organizado para defender derechos, que los acompañaran a la delegación de Ciudad Arce porque el fiscal quería hablar con ellos, sin orden judicial. Aún así, a la fuerza, los agentes subieron a cinco personas al pickup, los llevaron a la delegación y estando ahí, soltaron a tres voceros a quienes dijeron que se podían marchar, pero el líder y su esposa quedaron detenidos sin establecer el tema de la detención”, indicó.
Joya agrega que no dieron información, solamente a los abogados. Por la noche Medardo y Alejandra, fueron ubicados en delegaciones distintas “por lo que denunciamos, exigimos la libertad a los líderes, y que se respete el derecho a la integridad y que no sean sometidos a tratos crueles y inhumanos como está acostumbrada la policía y fiscalía en estos casos”.
Hasta el cierre de esta nota, aún no se había informado al equipo técnico de Unidehc la razón o presuntos delitos por parte de Medardo y Alejandra para estar en detención.
LA PRENSA GRÁFICA consultó, a través de los equipos de comunicaciones, a la PNC y FGR acerca de la denuncia de Unidehc y miembros de la comunidad La Floresta sobre la captura que consideran arbitraria a dos líderes de la localidad sucedido el pasado domingo 9 de febrero; al cierre de esta nota aún se esperaba su respuesta.
En mayo de 2024 Unidehc denunció el intento de desalojo arbitrario en la comunidad La Floresta, situación que fue denunciada ante la Fiscalía pero sin darse mayores avances en la investigación, según expuso Unidehc.
